Privacy Policy

GainXP ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains what information we collect, how we use it, and your choices regarding that information when you use the GainXP mobile app and website (collectively, the "Service").

1. Information We Collect

Information you provide

  • Account information — display name, email address, and password when you register.
  • Fitness & workout data — exercise logs, workout duration, completed quests, and other in-app activity you record.
  • Payment information — if you subscribe to a paid plan, payment details are processed by Stripe and are never stored on our servers.
  • Communications — messages or feedback you send us directly.

Information we collect automatically

  • Usage data — pages visited, features used, in-app events, and session duration.
  • Device information — device type, operating system version, app version, and a device identifier.
  • Log data — IP address, browser type, and error reports generated when the app crashes or encounters an issue.

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Service.
  • Personalise your experience, such as tracking your character progression and XP.
  • Process subscription payments and send receipts.
  • Send you service-related notifications (e.g., password resets, policy updates).
  • Detect, investigate, and prevent fraudulent or prohibited activity.
  • Analyse aggregate usage trends to make the app better.

We do not sell your personal information to third parties.

3. Sharing Your Information

We may share your information with:

  • Service providers — trusted vendors who help us operate the Service (database hosting via Supabase, payment processing via Stripe, crash reporting). These parties are contractually obligated to protect your data and may only use it to provide services to us.
  • Other users — your display name and public profile stats (level, class, leaderboard ranking) are visible to other users of the Service.
  • Legal requirements — if required by law, court order, or to protect the rights and safety of GainXP or others.

4. Data Retention

We retain your account data for as long as your account is active or as needed to provide the Service. If you delete your account, we will delete your personal information within 30 days, except where retention is required by law or legitimate business purposes (e.g., fraud prevention records).

5. Your Rights & Choices

  • Access & correction — you can view and update your account information in the app settings at any time.
  • Account deletion — you can request account deletion by contacting us at privacy@gainxp.app.
  • Marketing emails — if we send promotional emails, each will include an unsubscribe link.
  • California residents — you have rights under the California Consumer Privacy Act (CCPA) to request access to or deletion of your personal information. Contact us to exercise these rights.

6. Children's Privacy

The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, please contact us and we will delete it promptly.

7. Security

We use industry-standard security measures, including encryption in transit (TLS) and at rest, to protect your information. No method of transmission over the internet is 100% secure; we cannot guarantee absolute security.

8. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised policy.

Terms of Service

By downloading, installing, or using the GainXP app or website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. If you are between 13 and 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately if you suspect unauthorised access to your account.
  • One person may not maintain more than one account. Duplicate accounts may be terminated.

3. Subscriptions & Payments

  • Certain features may require a paid subscription. Pricing is displayed in the app before purchase.
  • Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
  • Refunds are handled in accordance with the App Store (Apple) or Google Play policies for purchases made through those platforms. For direct purchases, contact support@gainxp.app.
  • We reserve the right to change pricing with reasonable advance notice.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Falsify workout data, use bots, scripts, or other automated means to manipulate XP, leaderboards, or in-app progress.
  • Harass, abuse, threaten, or intimidate other users.
  • Post or transmit harmful, offensive, defamatory, or otherwise objectionable content.
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service.
  • Interfere with or disrupt the integrity or performance of the Service or its servers.

We reserve the right to suspend or terminate accounts that violate these rules at our sole discretion.

5. Intellectual Property

All content, designs, graphics, characters, game mechanics, and software in the Service are owned by GainXP or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written consent.

You retain ownership of any fitness data you submit. By submitting data to the Service, you grant us a non-exclusive, royalty-free licence to use that data to operate and improve the Service.

6. Health Disclaimer

GainXP is a fitness gamification app and is not a medical service. Content in the Service is for entertainment and motivational purposes only. Always consult a qualified healthcare professional before starting or changing any exercise programme. GainXP is not liable for any injury or health issue arising from use of the Service.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, GainXP and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim arising from the Service shall not exceed the greater of $50 USD or the amount you paid us in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Utah.

10. Changes to These Terms

We may update these Terms from time to time. We will provide at least 14 days' notice before material changes take effect, either via email or an in-app notification. Continued use after the effective date constitutes acceptance.
